Café Escapes® K-Cup® Pack Giveaway

NO PURCHASE NECESSARY TO ENTER OR WIN. A purchase will not increase your chances of winning. VOID WHERE PROHIBITED BY LAW OR REGULATION.

 1.       Promotion Period: The Café Escapes® K-Cup® Pack Giveaway (“Giveaway”) begins at 10:00 a.m. Eastern Time (“ET”) on December 2, 2013 and ends at 11:59 p.m. ET on December 6, 2013 (“Giveaway Period”), with five (5) separate entry periods, as defined below in section 3 (“Entry Period”). Sponsor, as defined below, is the official time keeper for the Giveaway.

2.       Eligibility: The Giveaway is open only to legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older as of their date of entry. Employees and family members of Green Mountain Coffee Roasters, Inc. (“Sponsor”), and each of its affiliated companies, subsidiaries, licensees, distributors, dealers, sales representatives, retailers, printers, individuals engaged in the development, production or distribution of Giveaway materials, their advertising and promotion agencies, and any and all other persons associated with the Giveaway (collectively, with Sponsor, the “Promotion Entities”), and each of their immediate family members (as defined by the IRS) and/or people living in the same household, whether related or not, are not eligible to participate. Void where prohibited by law. All federal, state, and local laws and regulations apply.

3.       How to Enter/Winner Determination: There is no purchase necessary to participate in the Giveaway. A purchase does not increase your chances of winning. To enter during the Giveaway Period, visit the Keurig Facebook Page at http://www.facebook.com/Keurig, “Like” Keurig on Facebook (if you do not already) and accept the Giveaway Application (the “Application”). Complete all required fields of the on-screen registration form. The information provided will only be used to contact the winners of the Giveaway and to add to Sponsor’s email distribution list. All entries become the property of Sponsor and will not be returned or acknowledged. If you are one of the first 10,000 entrants to submit a registration form during one of the Entry Periods during the Giveaway Period, you will win a prize, subject to verification. Once 10,000 prizes for each Entry Period have been awarded, the Giveaway will end. Sponsor will make the final determination as to the awarding of the prizes. In addition to the 10,000 winners per Entry Period, one entrant will be selected at random at the end of the Giveaway Period from among all entries received throughout the Giveaway to win one Café Escapes® K-Cup® Pack Sampler, subject to verification. Random drawing will be conducted by Sponsor, whose decisions are final on all matters relating to the Giveaway. Limit one (1) entry per person/email address. Entries will only carry forward to Grand Prize drawing and not to subsequent Entry Periods. Your information is being collected by the Sponsor and not by Facebook. Except as otherwise contemplated in these Official Rules, and to the extent entrants may otherwise elect at the time of entry, personal information collected in connection with the Giveaway will be used in accordance with the online privacy policy of the Sponsor. Any communication or information transmitted to Sponsor or the website by e-mail or otherwise is and will be treated as non-confidential and non-proprietary. Proof of submission is not considered proof of delivery to or receipt of such entry. Furthermore, Sponsor shall have no liability for any Submission that is lost, intercepted or not received by Sponsor. Entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized Account Holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

4.       Prizes/Odds of Winning: Fifty thousand and one (50,001) prizes (10,000 per Entry Period and one Final Prize) will be awarded of a sample pack of Café Escapes® K-Cup® Packs. The approximate retail value of each Prize is $2.99. All applicable taxes are solely the responsibility of the individual winners. No transfer, substitution or cash equivalent for the prize will be permitted, except at the sole discretion of the Sponsor due to prize unavailability for any reason, in such circumstance, an alternate prize of equal value will be awarded and the Sponsor’s obligation to the winners will be fulfilled, and no other additional compensation will be provided. Return of prize will result in disqualification.

Limit one prize per person/email address. The odds of winning a prize depend on the time an eligible entrant enters and the total number of eligible entries received. Winners will receive their prizes within 6-8 weeks after the end of the giveaway.

5.       General Rules: Entrants agree that the Promotion entities and Facebook: (a) shall not be responsible or liable for, and are hereby released from and against any and all third party claims, actions or proceedings of any kind, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Giveaway or any Giveaway-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (b) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. Sponsor assumes no responsibility for any damage to an entrant’s, or any other person’s, computer system which is occasioned by accessing the website or otherwise participating in the Giveaway, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Giveaway or the website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Giveaway, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No incomplete, software-generated or other automated multiple entries will be accepted. Sponsor reserves the right to terminate the Giveaway if it determines, in its sole discretion, that the Giveaway is technically impaired or corrupted or that fraud or technical problems, failures, or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Giveaway as contemplated herein. In the event an insufficient number of eligible entries are received and/or Sponsor is prevented from awarding a prize or continuing with the Giveaway as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required,

Sponsor shall have the right to terminate the Giveaway if it is not capable of running as planned, including due to bugs, tampering, fraud, technical or human error. If the Giveaway is terminated before the designated end date or before fifty thousand and one (50,001) eligible entries are received (as described above), prizes will only be awarded to those (per Entry Period) who completed the registration form before that point. Only the amount of prizes described in these Official Rules will be awarded. By participating in the Giveaway, you hereby represent and warrant that you have read these Official Rules and are fully familiar with its contents. The Giveaway and the Official Rules shall be exclusively governed by and construed in accordance with the laws of the state of Vermont, without regard to conflicts of law provisions. Participants submit to exclusive personal jurisdiction in Vermont and agree that any dispute shall be brought in the state and federal courts in Vermont.
